My home in Warrenville includes a private road not utilized by my family; it provides a thru road to my neighbor’s homes. It’s a PRIVATE ROAD; with a FORMAL DECLARATION regarding it’s maintenance, stating it’s to be maintained by the homeowners that benefit from its establishment. Some of these neighbors have neglected to provide for the viability of this road. Instead of establishing the homeowners association required, some have decided it would be in their best interests to dedicate the road to the city. The issue in dedicating is that this does not benefit me. Instead the dedication of the road would be a hardship on my property, it would decrease the size of my lot which is the minimal size required for a septic system, not to mention the fact that I PAID for the home and ALL of it‘s land. The city has interest in the neighbors' request for dedication, the stipulation being no payment for any of the land. Coincidentally the city, with the power of home rule, is fining me for it’s condition. Dear neighbors, I request that you repair my land as required by the declaration. It is the right thing to do.
